Terms and Conditions
These Terms and Conditions ("Agreement") govern the rental of 360 photo booths and selfie stands (collectively referred to as "Equipment") from Elite Class Celebrations ("Company") to the individual or entity renting the Equipment ("Renter"). By placing an order and renting the Equipment, the Renter agrees to be bound by the terms and conditions outlined below:
1. Rental Period:
The rental period begins on the specified start date and time agreed upon in the rental agreement and ends on the specified end date and time. Any additional time beyond the agreed rental period will incur additional charges at the rates specified by the Company.
2. Booking and Payment:
To secure a reservation, the Renter must provide a non-refundable deposit of $100 + 3% service fee at the time of booking. The remaining rental fee must be paid 5 days before the event. Payments can be made via Cashier’s Check, Cash App, Venmo, or Zelle.
3. Equipment Use:
a. The Renter agrees to use the Equipment only for its intended purpose as outlined by the Company. Any use of the Equipment for illegal or unauthorized activities is strictly prohibited.
b. If the client chooses an outdoor location, we must be in a totally dry spot, on a flat paved or grassy surface free of dirt and oily substances. Must be protected from wind, cold, heat and direct sunlight.
c. We are not the 'fun police,' but in rare cases, we reserve the right to immediately refuse service, pack up and depart from the event. Booths will be stopped if attendants are harassed, threatened, or abused by any guests and/or the equipment is damaged by any guests. The Client will be financially responsible for any damages.
4. Care and Maintenance:
The Renter agrees to take proper care of the Equipment and use it in accordance with the provided instructions. Any damage resulting from misuse, negligence, or improper handling will be the responsibility of the Renter and may incur additional charges for repairs.
5. Liability and Indemnity
The Renter agrees to indemnify and hold harmless the Company from any claims, damages, liabilities, costs, and expenses arising from the use or misuse of the Equipment during the rental period.
6. Cancellations, Refunds, and Changes:
a. In the event of cancellation, the non-refundable deposit will not be returned to the Renter.
b. Any request for a date change must be made at least 30 days in advance from the original date. Changes are subject to equipment availability and receipt of a new service contract. If there is no availability for an alternative date, the deposit shall be forfeited, and the event cancelled. Any cancellations shall forfeit all payments received.
7. Delivery:
a. The Company will deliver and set up the Equipment at the specified location and time as agreed upon in the rental agreement.
b. The Renter shall ensure that the venue is accessible and ready for the delivery and setup of the Equipment. Any delays or additional costs incurred due to inaccessible venues will be the responsibility of the Renter.
c. Before booking, please verify with your event location the following: A minimum space of 10ftx10ft and Accessible Wi-Fi.
d. Elite Class Celebrations will arrive at the event and be ready by the time agreed upon. We will arrive within 1 hour of the event’s start time. If you would like us to arrive earlier, idle time is a charge of $49 per hour. Rental will run 100% of the time of the event, but occasionally will need to be stopped for maintenance. If by chance the photo booth has technical difficulties and is unable to function during contracted time, the amount of downtime will be added to the end of the event to ensure the client receives the full benefit of their contracted time. If by unforeseen circumstances, the rental is unable to be repaired or replaced at the event, the client will receive their choice of credit for the unused time (to be used on a future event based on availability or prorated refund for unused time. This does not apply to outdoor rentals if weather or outdoor circumstances determine downtime. If the client decides during the contracted event, they would like an additional time, additional prices will be discussed.
e. Any event over 30 miles from Columbus will incur an additional fee.
8. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of Franklin County. Any disputes arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts in Franklin County.
By proceeding with the rental, the Renter acknowledges that they have read and understood these Terms and Conditions and agree to abide by them.
